In 2013 my son Andreus Matteo Ybarra dob: 08/16/2007 was taken by CPS in Maricopa County city of Glendale in August and he was put in the care of his paternal Aunt Joanne Ybarra of Peoria‚ AZ shortly after. In 2014 I was sent to Arizona State Prison for women in Buckeye‚ AZ for 4 years and at that point CPS changed the goal from family reunification to severance and adoption. It was stated during the proceedings that Joanne wanted to adopt Andreus. Because she was family and was a suitable caretaker after my rights along with the father's (Tommy Ybarra who was also incarcerated at the time) were severed the process for her to legally adopt him would start. I did not have any contact with her or any other family members on his father's (Tommy Ybarra) side during my incarceration. I attempted to write to the grandparents house but didn't know the address for sure so I don't know if they received them but none were returned to me. In 2017 I was released from prison‚ I did attempt to reach out to Joanne via messages through Facebook Messenger as well as text. My intent was to provide some kind of financial support even if she didn't want to allow me to see him that I would respect that but I still wanted to help. I never did get a response from her or any of the other family members. It was about 2 months after my release through a mutual friend and previous neighbor of hers that I was informed that she no longer had custody of Andreus and that he was returned to CPS only 1-2 months after my rights were severed. Through one set of messages shortly after between myself and the girlfriend of his father it was confirmed that Andreus was no longer in the family's care. I called CPS trying to find out what happened to him once Joanne relinquished herself as his caretaker and after many attempts to any DES or CPS numbers I could find a lady finally would only confirm that he was returned to CPS and put back into foster care but any other information was sealed and could not be provided to me. I made several attempts over the years to research and find information online that could at least confirm that he was not at a children's home and if so could they contact the adopted mother (Markitta Paulson‚ of Florence AZ at that time‚ a former CPS foster parent for many years) of his siblings (my daughters Kerriauna‚ Juliana‚ Serina Paulson) to get custody of him or even one of my siblings who would have been willing to take him. I found several different online posts about the fact that CPS is supposed to extend all efforts to connect children in foster care with biological family members that could take a child before they are just passed out into the system. At that point I began reaching out to CPS again to find out why I was not contacted by CPS after the adoption with his aunt fell through to see if there was anybody else that could take custody of him. All of the CPS court proceedings took place with me on a conference call from the prison so CPS‚ his case worker‚ guardian adlietum and the courts as well his father's family knew that I was there. I received all my court paperwork there so it made no sense to me that I was never asked if there was another option. I was told by the CPS "supervisor " that took my call that because my rights had been severed prior to the court proceedings for Joanne to adopt him that CPS did not and legally could not contact me regarding my son because I no longer had rights to him. I asked her how that was fair when it was stated by the attorney for CPS several times during the proceeding that they were doing the severance with the intentions of Joanne adopting him. I asked how it was legal that when that expectation didn't occur it was no longer CPS's responsibility to attempt keep a child connected with family and people he already knew if at all possible. I was tried to find a pro-bono or low cost family attorney that could/would help me‚ the attorney offices I called stated that they did not do any pro-bono cases for family court. I did not know about advocacy services at the time and at that point no longer knew what to do. I have randomly over the years tried searching for ways to provide my information somewhere children could one day look for their parents and have found this site. I don't know if his name is changed or where he could be. I want to at least provide my information and his 3 sister's would like to do the same.
